Terms and conditions

1. Scope

These terms apply to all contracts, deliveries and services between customers and Hirsch Racing (owner: Waldemar Hirsch) via jlr-activations.eu.

Deviating conditions do not apply. German law applies exclusively. The UN Convention on Contracts for the International Sale of Goods is excluded.

2. Subject of the service

The service is the software-side activation of functions and output levels that the manufacturer has provided for in the vehicle software but which are not enabled depending on market or equipment. No components are modified, added or removed.

We do not carry out modifications outside the manufacturer's own parameter set, and we do not install additional hardware. The configuration can be returned to its original factory state at any time.

Whether a given configuration requires entry in the vehicle documents, or affects type approval or insurance cover, is determined by the rules of the country in which the vehicle is registered. Those rules differ between markets and can change. The customer is responsible for compliance with them and, where required, for obtaining the necessary approvals. We are glad to document what was activated on request.

3. Formation of contract

Published offers are non-binding. Submitting a VIN is a free and non-binding enquiry. A contract only comes into existence once we have confirmed compatibility, you have selected and confirmed your configuration, and payment has been completed.

Technical modifications to the vehicle must be disclosed in advance.

4. Prices and payment

Each vehicle has one fixed package price. All factory features released for that vehicle are included in it; the number of features the customer selects does not change the amount.

All prices include VAT. Payment is due immediately without deduction. The activation is carried out after payment has been received in full.

5. The customer's contribution

The customer makes the vehicle available for the activation and, depending on the route chosen, provides a stable internet connection at the vehicle, a suitable laptop with an OBD ENET cable and, where required, a connected battery charger.

6. Warranty and liability

Statutory warranty rights apply. We are liable without limitation for damages arising from injury to life, body or health, in cases of intent or gross negligence, in the event of fraudulent concealment of a defect, where a guarantee has been given, and under the German Product Liability Act.

In cases of slight negligence we are liable only for the breach of a material contractual obligation, that is an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose fulfilment the customer may regularly rely. In such cases liability is limited to the damage typical for this type of contract and foreseeable at the time the contract was concluded.

Any further liability is excluded. The statutory rights of consumers remain unaffected. The above limitations also apply in favour of our employees and of any third parties we engage to perform the contract.

We do not owe a particular measured performance figure for an individual vehicle. The output levels we state are those of the higher factory variant; whether one of them can be activated on a given vehicle is established by the VIN check before the contract is concluded.

7. Return to stock

The configuration can be returned to its original factory state at any time on request, free of charge. This applies without a time limit. Any costs of making the vehicle available, and of a connection suitable for the session, are borne by the customer.

8. Data protection

Personal data is processed solely to perform the contract. For details see our privacy notice.

9. Partner sites

Where the work is carried out at a partner workshop, a separate contractual relationship arises between the customer and that partner. Hirsch Racing is not liable for their services.

10. Right of withdrawal

Consumers have the statutory right of withdrawal. Details, and the conditions under which it may lapse, are set out in the withdrawal policy.

11. Final provisions

The place of jurisdiction is Ostrach, to the extent legally permissible. Should individual clauses be invalid, the remainder of the contract stays in force. German law applies exclusively.

12. Independence

JLR Activations is an independent specialist and is not affiliated with, endorsed by, or part of Jaguar Land Rover or its affiliated brands.

13. Language

These terms are concluded in English, and the English version is the binding contract language. Hirsch Racing is established in Germany; where German law prescribes the wording of a statutory notice, that German wording governs for the notice concerned. We provide the German wording on request.
